Terms and Conditions for the We@FHSS mobile app

1. About these terms
These terms govern your use of the We@FHSS mobile application, provided by the Faculty of Humanities and Social Sciences, University of Sri Jayewardenepura ("the Faculty", "we", "us"). By signing in to the app you accept them. If you do not accept them, do not use the app.
How the app handles personal data is described separately in our Privacy Policy.
2. Who may use We@FHSS
The app is for enrolled students and academic staff of the Faculty who hold a Faculty email account. There is no public registration, and the app has no function for anyone outside the Faculty. Your access depends on your account remaining active; the University deactivates accounts on graduation, withdrawal or departure.
3. Your account
Your Faculty email account is personal to you. It is issued by the Faculty, not by the University's central services, and it is the only account the app accepts. You are responsible for keeping your credentials and your device secure, and for anything done through the app while signed in as you. Do not share your credentials, and do not let another person use the app while you are signed in. Tell the Faculty immediately at ict.fhss@sjp.ac.lk if you believe your account has been used by someone else.
4. Acceptable use
You must not:
- Mark attendance for anyone other than yourself, or arrange for another person to mark attendance on your behalf. Doing so is falsification of an academic record and is dealt with under the University's disciplinary rules, in addition to the removal of app access.
- Attempt to intercept, replay, relay, simulate or otherwise interfere with the signals used to confirm attendance, or to reproduce them outside the lecture hall.
- Run the app on a rooted, jailbroken, emulated or otherwise modified device, or modify, decompile or repackage the app.
- Attempt to gain access to data belonging to another student or member of staff.
- Use automated means to access, scrape or overload the app or its servers.
- Use the app for any unlawful purpose, or in any way that disrupts teaching.
5. Attendance
Attendance is marked in the lecture hall, during the class, by a direct short-range exchange between your device and your lecturer's device. Marking may fail for ordinary reasons: a permission the app needs has been switched off, you are too far from the lecturer, the device is unsupported or modified, or the class has already ended.
If your attendance does not mark, raise it with your lecturer during the class. Attendance disputes are resolved by the Faculty, not within the app, and the Faculty's records are final.
6. Academic information is indicative
Timetables, attendance summaries, results and announcements shown in the app are provided for convenience. The University's official records are the authoritative source. Where the app and the University's records differ, the University's records prevail. We do not guarantee that information in the app is complete, current or free of error, and you should not rely on it alone for any decision that matters academically.
7. Availability and changes
We provide the app as it is, without any guarantee of uninterrupted or error-free service. We may change, suspend or withdraw the app or any of its features, and we may require you to install an update in order to continue using it. Older app versions may stop working when the systems behind them change. Access depends on network connectivity, your device, and services operated by third parties.
8. Suspension of access
We may suspend or withdraw your access to the app if your Faculty account is deactivated, if we believe these terms have been breached, or if suspension is necessary to protect the integrity of academic records or the security of the service.
9. Intellectual property
The app, its name, logo, design and content belong to the Faculty of Humanities and Social Sciences, University of Sri Jayewardenepura, or to its licensors. You are granted a personal, non-transferable, revocable licence to use the app for the purposes described in these terms, and no other rights.
10. Liability
To the fullest extent permitted by law, the Faculty is not liable for indirect or consequential loss, or for loss arising from your reliance on information in the app, from attendance that failed to mark, from unavailability of the service, or from your own failure to keep your account or device secure. Nothing in these terms limits liability that cannot lawfully be limited.
11. Apple and Google
These terms are between you and the Faculty only. Apple Inc. and Google LLC are not parties to them and are not responsible for the app or its content. Apple and Google have no obligation to provide support or maintenance for the app, and no responsibility for any claim relating to it, including claims of product liability, failure to conform to a legal requirement, or infringement of intellectual property rights. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you. Where these terms conflict with Apple's Licensed Application End User Licence Agreement, that agreement prevails to the extent of the conflict.
12. Governing law
These terms are governed by the laws of Sri Lanka, and the courts of Sri Lanka have jurisdiction over any dispute arising from them. If you are a consumer resident elsewhere, this does not deprive you of the protection of mandatory provisions of the law of your country of residence.
13. Changes to these terms
We may revise these terms. The revised version takes effect when published on this page, and the "last updated" date above will change. Continuing to use the app after that means you accept the revision.
